我国公诉权制约制度评析

Comment on the Restrictive System of Our Right of Public Prosecution

  • 摘要: 为了防止公诉权滥用.我国建立了政法委协调案件制度、人大个案监督制度、人民监督员制度、检察机关的内部监督制度.但是制约表现为任意性、单向性、片面化、地方化、权力化的特点,导致对公诉权的制约演变成干预,因此应当加以完善.

     

    Abstract: In order to prevent the abuse of right of public prosecution, our country has established the system of coordinating cases by political and legal committee, the system of supervising cases by people's representative congress, the system of people's supervisors and the internal supervision system of procuratorial organs. But restriction is characterized by arbitrariness, single way, onesidedness, localization and participation of power so that the restriction of public prosecution right is developed into interference. So it should be perfected.
