Abstract: Algorithmic administration is a new governance model formed by embedding algorithm technology into government governance system. Data, algorithmic decision-making, code and law are the three cornerstones of algorithmic administration generation, reconstructing government power and organizational structure. At present, there are some risks in algorithmic administration, such as transfer of administrative authority, improper administrative procedures, weakening of administrative counterpart rights, and fuzzy responsibility of administrative subject. Therefore, it is necessary to control the administrative risks of algorithms from the legal level, including reasonable restrictions on the decision-making power of algorithms, the construction of algorithmic administrative due process, the granting of algorithmic rights to administrative counterparts, and the attribution of responsibilities to the main body, so as to standardize the application and development of algorithmic administration.
