Abstract: Non-penal measures for ecological restoration are one of the important means for judiciary authorities to participate in the construction of ecological civilization in China, and are of great significance in restoring the ecological environment damaged by environmental crimes. Based on nearly 8,000 environmental criminal cases since the establishment of the Jiangxi Ecological Civilization Pilot Zone, the study analyzes the application of non-penal measures for ecological restoration in China. Research has found that there are problems in the application of non-penal measures for ecological restoration by judicial authorities, such as low implementation efforts, high evaluation costs, limited sources of funds, and difficulties in supervision. Based on this, it is necessary to improve the judicial application of non-panel measures for ecological restoration in China from the aspects of improving relevant systems for ecological restoration, reducing the evaluation cost of ecological restoration, expanding the sources of ecological restoration funds, and improving the supervision mechanism for ecological restoration.
