Abstract: At present, the criticism of the court trial is lack of adequate standards, leading to the loss of the court’s judicial credibility. The fourth plenary session of the 18th Communist Party of China proposed to regulate the media reports judicial, punish to the act of contempt of court authority. In the future, criticism of the court should be appropriate to respect the judicial authority, and shall not damage the judicial independence, to prevent the realization of judicial justice as the principle. At the same time, criticism should not be an insult, slander, whether subjective is malicious, whether it has a malicious, objectively, whether the statement has a thought or opinion expression value, is the important measure to define the limits of criticism. Criticism should be allowed for the cases being heard, but the criticism should not cause the “obvious and immediate danger”, and can not become a “trend report” to form a “public opinion trial”. The court for the illegal and critical behavior should be actively and carefully regulated, at the same time, it is necessary to promptly and efficiently respond to criticism, to clarify the error reporting, and reasonably guide public opinion.
