Abstract: Smart cars and automatic driving are considered to be one of the most promising achievement of AI technology. The reality of the risk of traffic damage caused by smart cars requires the tort law to respond to the issue of tort liability in it in order to eschew the paucity of effective laws regarding to the infringement caused by the large-scale application of high-tech AI in the future. The situation clarifies the main body of responsibility and the principle of liability, while constructing a system of diversified tort liability, which reasonably shares the damage and effectively resolves the risks.
