我国网络舆论监督权力的法律规制历程

The Course of the Legal Regulation of the Supervision Power of Network Public Opinion in China

  • 摘要: 我国网络舆论监督权力的法律规制是个渐进的过程,它与舆论所依赖的网络平台的发展状况以及人们对网络法律规制的认知有着紧密的关系,与我国总体的法治状况直接相关。网络舆论监督权力的法律规制历程迄今为止大致可分为3个主要阶段:即网络舆论监督权力的法律规制初建阶段、逐步完善阶段和深入推进阶段。在规制理念上分别体现为网络自由主义、网络管制主义和中国特色社会主义法治理念。网络舆论监督权力的法律规制总体呈现出不断进步的同时,也暴露了一些普遍存在的影响法律规制效果的问题,这些问题的存在及网络舆论监督法治实践的不断变化决定了网络舆论监督法律规制任重道远。

     

    Abstract: The legal regulation of China’s network public opinion supervision power is a gradual process. It has a close relationship with the development of the network platform on which public opinion depends and people’s cognition of network legal regulation. It is directly related to the overall rule of law in China. The course of the legal regulation of network public opinion supervision power can be roughly divided into three main stages: the initial stage of legal regulation of network public opinion supervision power, the stage of gradual improvement and the stage of further advancement. In the concept of regulation, it is embodied in the concept of network liberalism, network regulation, and socialist rule of law with Chinese characteristics. The legal regulation of network public opinion supervision power shows continuous improvement, and it also exposes some common problems affecting the effect of legal regulation. The existence of these problems and the constant changes in the practice of network public opinion supervision rule determine that the supervision of network public opinion has a long way to go.
