Research into the Present Situation and Countermeasures of Judicial Proposal System

Judicial proposal is an important content of the court to participate in social management. It is also one of approaches by which the court participates in social management with the autonomous judicial idea. At present our judicial proposal system is not perfect. This article reveals the connotation of judicial proposal by clarifying the main body of judicial proposal, and summarizes the current problems of judicial proposal and their reasons. It aims to establish the effective mechanism of judicial work as the breakthrough and by making clear the three basic elements of judicial suggestions, builds a set of judicial work flow conforming with trial practice so as for courts to find problems, reflect problems, solve problems in the process of the participation in social management. This is the fundamental value and the ultimate goal of the court to exercise power of judicial proposal.
