On the Improvement of China's Real Estate Expropriation Procedure

China's regulations of real estate expropriation procedure are scattered in all kinds of laws and regulations. There are some problems in legislation of China's real estate expropriation procedure. These problems include the law itself,the mechanisms of public's participation,remedy procedure and the operability of the real estate expropriation procedure. The legislation of real estate expropriation in the United States,France,Germany,Japan and China's Taiwan region is more perfect,and worth learning. Therefore,measures should be taken to perfect the real estate expropriation procedure. First,we should enact the real estate expropriation and requisition law,as the general law of real estate expropriation procedure; Second,we should improve the public announcement system and add the procedure of agreement requisition by purchase and increase the opportunity for expropriated person's participating and expressing; Third,we should improve the relief mechanism of expropriation purpose and compensation; Fourth,improve the operability of the real estate expropriation procedure.
