The Unification of Ethicality and Property Attribute of Couple Joint Debt——As Described in Article 24 of the No.2 Interpretation of Marriage Law

This paper take the unification of ethicality and property attribute of couple joint debt in theory and legislation practice as a starting point. Combining with the problems encountered in the design of couple joint debt law system of China, we tried to analysis the disconnection between ethicality and property attribute in the marriage law about one of the couple have a large debt without the other's authorization, then to find out and put forward the concept of "special couple joint debt" and "limited liability" in the re-comprehended marriage law. Finally, we hoped to find a way approach to unify the ethicality and property attribute on purpose.
