On the People’s Congress Case Supervision——taking the rationality and the validity as an angle of view

The people's congresses case supervision from the beginning became a controversial issue.Some people who are very dissatisfied with the presence of a large number of corruption in the judiciary think it is the best way to overcome this shortcoming.However,according to the modern constitutional concept,combining the characteristics inherent of judicial power,the court should exercise independently jurisdiction.The appearance of the people's congresses case supervision,have seriously violated the principle that the judicial authority exercises independently,caused judicial unfair intensifying,and broken the regime balanced pattern which the constitution has established.
