Logical Analysis of Explicitness and Ambiguity of Criminal Linguistics
-
Abstract
In doctrine of statutory law, criminal norms are manifested as legal texts with language and words as carrier.Explicitness and ambiguity constitute two basic natures of criminal linguistics,of which explicitness reflects the rigid requirements of criminal law while ambiguity reflects the requirement for flexibility.Ambiguity does not inevitably undermine the explicitness of criminal law.The explicitness can not be pursued at cost of sacrificing justice of criminal law.Balance between explicitness and justice of criminal law should be advocated, which reflects the principle of nullum crime sine lege.
