Thinking on Commercial Credit System in Data Governance

Data governance is not the application of simple data technology, but covers the assets of data resources, data rights confirmation and compliance, data value creation and many other contents. It involves the coordination and standardization of the interests of all relevant parties of data assets, and requires the follow-up of corresponding governance rules. In the face of such undesirable phenomena as “data lies”, “data falsification” and lack of data usufruct credit, a commercial credit system of data governance can be established from the perspective of rigid provisions of “hard” law and flexible guidance of “soft” law, in order to emphasize the performance of data usufruct fiduciary obligations and the guarantee of performance ability. This will play a positive role in curbing the moral hazard in data usury, ensuring the technical neutrality of data processing, improving data quality and realizing data value.
