The Inevitable Transformation of Governance Mode of Corporate Crime in ChinaFrom the Perspective of Criminal Compliance

  • In recent years, corporate crime has been in high incidence. In our country, the defects of model of corporate crime prevention have to be reflected. How to correct them is worth pondering. The model of criminal law regulation and corporate self-management advocated by criminal compliance can provide an example for our corporate crime prevention. Criminal compliance are the measures that the corporate formulate and effectively implement according to criminal law and corporate, in order to avoid the risks and harms caused by the crimes of the employee. These measures are recognized and encouraged by criminal law. Specifically, the implementing of criminal compliance requires that criminal law changes Schuldprinzip partly and works with the inner measures of corporate. The organic combination can lead to a better result on corporate crime prevention.
